Review of alleged offence

Council will accept written submissions detailing circumstances which could be relevant for consideration to withdraw an Infringement, such as an error in the infringement notice details, or where a defence can be demonstrated for the alleged offence occurring. For example an emergency health situation, or a confirmed vehicle breakdown necessitating the stopping of a vehicle in a parking restricted zone.

Statutory declaration (vehicle related offences)

Council will issue an infringement to the registered owner of a vehicle where the person in charge of the vehicle cannot be spoken to directly. In cases where the registered owner was not the driver or not in charge of the vehicle at the time of the alleged offence, a statutory declaration may be submitted to Council stating this and nominating the driver.

If satisfied with this information, Council will withdraw the infringement and may issue a fresh infringement on the nominated person who was in charge of the vehicle at the time of the offence.
